Macro uranium South Dakota · precedent watch

On June 30, 2026, the U.S. federal Permitting Council announced the completion of federal permitting for enCore Energy's (NASDAQ/TSXV: EU) Dewey Burdock in-situ recovery (ISR) uranium project in Custer and Fall River counties, South Dakota — the first project from South Dakota ever added to the FAST-41 federal permitting program. enCore's Executive Chair stated the company now looks to finalize state permitting, begin construction, and ultimately produce. State-level permitting with South Dakota's DANR is underway; the department has publicly said its timeline is "difficult to predict." The project has drawn stated opposition from the Black Hills Clean Water Alliance, the Oglala Sioux Tribe, and NDN Collective.

Context — South Dakota's Edgemont district sits in sandstone-hosted, roll-front uranium geology comparable to active ISR jurisdictions in Wyoming and Nebraska, and hosted conventional uranium mining historically — but has seen no modern ISR development, in part because the state's ISR permitting pathway had never been carried to a federal completion. Dewey Burdock is the first project to reach that milestone. A completed precedent changes what that pathway looks like for any project in the same jurisdiction, deposit type, and regulatory regime that follows it.
